Wedding Photography Terms & Conditions

 

In the following terms & conditions the 'photographer' shall mean Nikita Mansell. "The clients" shall be those defined as Bride/Groom upon booking. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing

 

.Booking Fee / Deposit payment

 A non refundable booking fee of £250 is required to secure your date. The booking fee will be deducted from the couples chosen package and remaining balance is to be paid 8 weeks before the wedding date.

Cancellation.

The Client may cancel at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Full payment will still be due if Cancellation is less than 8 weeks before the wedding date. All cancellations must be in writing.

Display

I will also ask to display your images for advertising purposes. This will include sample albums, blogs and social media. If for any reason you do not want me to share any photos, please let me know prior to the day.

Attendance

In the unlikely event of me being unable to attend your wedding due to unforeseen circumstances, I reserve the right to appoint another photographer to attend your wedding on my behalf. They would undertake the wedding photography to his/her best ability and I will edit and finalise the gallery.

COPYRIGHT

The Copyright Designs and Patents Acts assign the copyright of the images to the photographer (Nikita Mansell). The Photographer (Nikita Mansell) assigns full Usage Rights/print  rights to The Client for personal use. The Client may reproduce, copy and distribute the photographs.

Suppliers from the day can use images for their portfolio. The image must be credited to Nikita Mansell photography, and they must email Nikita Mansell to arrange usage rights for the  images they wish to use, to be able to compile with GDPR – nikitamansellphotography@outlook.com

 LICENSES, COVERAGE AND REPRODUCTION

Photographs taken during the course of the event will be at the discretion of the photographer(s) although every effort will be made to comply with The Client(s) requirements.

The photographer shall endeavour to photograph specific people as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of missing somebody out.

For a booking involving a church ceremony or at certain venues, the photographer(s) movements are sometimes restricted by the official in charge. The area from which the photographer(s) is able to cover the ceremony may not be the photographer(s) choice and the photographer(s) cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. The photographing of parts or even all of the ceremony may be restricted or prohibited. Client(s) are strongly advised to check with the appropriate official before booking the date and submitting this contract.

For a wedding or other event booking the photographer(s) shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for logistical reasons.

Please note that any alterations made to the booking by the client(s) once details have been confirmed may only be made at the discretion of the photographer and in some circumstances (such as the change of ceremony date for a wedding) the photographer may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances the photographer is not liable to compensate the client(s) in any way whatsoever.

Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Please note that certain colours do not reproduce exactly in print.

It is agreed that the Photographer(s) shall be the sole professional stills Photographer on the wedding day. Although the Photographer will actively encourage the use of cameras throughout the wedding it is agreed that the Photographer shall reserve the right to ask guests to refrain from taking photographs in the event that their activities are corrupting the official photography in any way.

Images are not to be edited by anyone other than Nikita Mansell, this includes Instagram filters or anything that might alter the look and style, or change integrity of the photography work, unless this has been otherwise organised with Nikita.

COMPLAINTS

Any complaints must be received in writing within seven days of receipt of products purchased. This includes photographs, USB, albums, frames and any other special services that have been agreed.

MEALS AND REFRESHMENTS

A meal/lunch is much appreciated please if working over 8 hours, often it is hard to be able to get a chance to get food and going off site is not always possible (this is not usually taken with your guests as the photographer has important duties to perform during this period). The photographer will take a short break and eat away from guests.

TIME FRAMES

USB with photographs : The Photographer will post the USB up to 8 weeks after the client(s) wedding. It will be posted by Royal Mail, unless other arrangements have been made. The full set of photographs will be available to view on your online gallery 6-8 weeks after the day.

Requested Photographs

I cannot be held responsible for lack of coverage caused by any member of the wedding party not being on time, or by Church, Register Office or Licensed Place imposing photography restrictions. We will strive to honour all photographs requested and agreed in advance, but cannot be responsible for weather disturbances, lack of timing and a schedule that is behind. Although all efforts will be taken to provide the agreed coverage. It is recommended that a list of group shots is provided prior to the day if you require formal shots, Please keep in mind that a lengthy shot lost will take a lot of time out of your day and natural moments will be missed during this time. I highly recommend booking a second photographer onto your package if you do have a long shot list.
